Expungement is the legal process of erasing all publicly available records of an arrest. If an expungement is granted, it is as if the arrest never occurred in the eyes of the law.
Unfortunately, unlike many other criminal offenses in South Carolina, a DUI conviction cannot be expunged from your record. However, the DUI arrest itself can be removed from your record under certain circumstances.
- Dismissal of the DUI charge by a Judge or a Prosecutor
- Not Guilty Verdict
- Reduction of the DUI to a lesser charge.
